AWBI has taken cognizance  and have issued a strong advisory to RWA-Close North, Nirvana Country. Content of the advisory is mentioned below. Moreover, AWBI has also promised all possible support to us on this matter.
We hope that a better sense would prevail with the RWA and they will act on requirements as outlined by AWBI.

Dear Pet Parent Association,

I am an Executive Committee Member of the Animal Welfare Board of India, and its legal adviser. After a perusal and due consideration of the contents of your mail, I have been required by the Chairperson, AWBI, Maj.Gen. (Retd.) Dr. R.M. Kharb, AVSM, to respond.
Your mail, and its contents are very apt.
Indeed the RWA must do what you have required them to do, i.e. as requested by you –
  • Prominently display AWBI circular dated 20th Feb on all notice boards (both electronic and physical) across the society
  • Instruct your BOM members, estate office personnel and other support staff to understand and abide by the laws pertaining to animal welfare
  • Moderate and restrict such discussions / comments on online and offline forums / gatherings managed by your RWA that may instigate and spread hatred against animals and people who tend and care for animals.

In fact, the RWA is supposed to ensure that the laws of the land are upheld, and never sit back and allow infringements and violations to take place.

Please continue to stand up strongly against breaches of law. You will be happy to know that the Hon’ble Supreme Court of India itself, has in a judgment pronounced on 7th May, held animal rights to be an issue of seminal importance, and issued directions to the central and state governments, and all public authorities to strongly uphold animal protection laws.

It has been observed that in your society there are increased incidents of animal cruelty and harassment of people who tend and feed stray dogs that resides in your gated community.

Moreover, the online forums like apartment-adda and google groups that are directlymanaged by you are being used to harass, intimidate and spread hatred against law abiding citizens that care for animals.

Some of these communication and email postings are not only intimidating but also provoking in nature, wherein others might get instigated to remove stray from gated community, socially boycott people who care for stray animals, inform landlords to evict them, put illegal restrictions etc.

We would like to draw your attention to the attached AWBI circular dated 20thFebruary which outlines and set out what is lawful, and what is unlawful, on the subject of treatment or mistreatment of pet dogs and street dogs.

As RWA you are supposed to make all residents aware of such important circulars and regulations related to community well-being including animal welfare.

You are requested to:

  • Prominently display AWBI circular dated 20th Feb on all notice boards (both electronic and physical) across the society
  • Instruct your BOM members, estate office personnel and other support staff to understand and abide by the laws pertaining to animal welfare
