The Animal Welfare Board of India has received a serious complaint against the staff of

Metro Walk mall at Rohini, regarding violation of the animal protection laws, and the

meting out of extreme cruelty to a stray dog only because he happened to be in the vicinity,

from 2 concerned and disgusted persons who were a witness to the incident. As counsel

representing the Board, and authorized by its Chairperson, Maj. Gen. (Retd.) Dr. R.M.

Kharb, AVSM, to do so, I am reproducing the complaint, and then putting you to notice as

follows:

liThe Complaint:

Thismorning I had gone to Metro Walk mall Rohinifor some work while

waiting, I saw some commotion and i saw few guards chasing a stray

dog. SoI went closer and to my shock a guard hit the dog on hisface

and dog fell aside.1protested and they all gathered in a group and

started arguing that this isa mad dog, what if he bits the children etc.

ect. i mean justifying their actions. I shouted at them that this

inhumand and not right. Then I picked up that dog with my friend and

took him to Dr Vijay who examined and gave first aid and then dog

was taken to Sonadi trust.

Please do announce to the animal lovers group to shun metro walk

mall or whenever they visit that mall to be alert to c any other

casuality.

Kindly bear in mind, firstly, that as per Indian law you cannot ‘drive’ stray dogs away,

through violence, or dislocate them in any other way. They can merely be sterilized (by the

municipality together with the animal welfare organizations partnering with it) in the

manner envisaged in the Animal Birth Control (Dogs) Rules, 200 1, vaccinated, and then

returned back to their original locations. [For the area-wise sterilization program being

followed in Delhi, and because the law mandates it, dogs have to be returned back to their

original habitat after sterilization and immunization.]

Further, that animal cruelty is an offence – under Section 11 of the Prevention of Cruelty to

Animals Act, and Sections 428 and 429 of the Indian Penal Code – punishable with

imprisonment and fine. Therefore, your staff may be instructed by you forthwith, to shelve

any plans that may be afoot to remove the dogs in the area, or treat them with any manner of

cruelty.

You are also hereby put to notice that failing the same, and if any similar incident occurs

within or in the vicinity of your mall, we shall prosecute the perpetrators, and the

management of the mall, in the manner warranted by law.

You are put to notice accordingly.
